Federal Law And Stress or
Sleeping On The Job - Part II...
...and getting away with it.
In part one you learned how to deal with
stress on the job via the state Workers' Compensation system.
In part two, you'll use Federal law to help you out.
This is very powerful stuff. You do not want to engage
into this lightly. You do not want to fake injury or
illness as that could
land your sorry butt in jail. If you want workplace laws to
work for you, you must play the game by the law.
Say for instance that your doctor has you on
some type of medication that is causing you insomnia. True
story. Happened to me. I was diagnosed with high
cholesterol. My doctor put me on Lipitor. In my
follow-up visits, I told the cardiologist that it was making me
sleeping. He said there was nothing in it to make me sleepy.
I thought it was stress on the job because I
was being micro-managed on a project from hell. I woke up
around 1:00am every night and didn't get to sleep until about
4:30am. I had to literally drag myself out of bed. Lucky
for me I worked out of my home so I didn't have the usual primping
and travel time that other workers have. I couldn't
concentrate on my work and many days I found myself back in bed
before noon. I plowed through a lot of my personal Paid Time
Off hours.
Months later I found a Lipitor forum where
people had complained of the very same thing I was experiencing.
It was like looking in a mirror. They had the same symptoms I
did.
Then steps in a nurse friend of mine.
She's an RN and did a little research for me. She found out
that once the Lipitor has your cholesterol under control, you may
not need to take it in the same dosage. You may be able to
split the pills in half and take only half the dose. Or even
take them every other day and still keep your cholesterol under
control.
Being on a statin drug like Lipitor, I had
to have blood work done every six months to make sure my liver
wasn't being destroyed and that my cholesterol levels were in check.
Unbeknownst to my doctor, I started splitting pills. My
6-month blood work was fine. Then I started taking the half
dosage every other day. Again, blood work was still fine.
I finally stopped taking it because my
eating habits were nothing compared to what they were when I had
high cholesterol. Blood still tested fine. I'm not going
to get into pharmaceutical company ethics and how they want you to
stay on their drugs for the rest of your life because that's off
topic.
The
point I want to make is this, years later when I got the Work Laws
Exposed e-book, I discovered that I could have used a federal law to
shorten my work day by coming in late and if need be, I could have
taken huge blocks of time off for weeks at a time without using any
of my PTO hours. I could have slept in every morning without
losing my job and sleeping in wouldn't have been out of laziness or
attempting to skirt unfavorable working conditions. I had a
definite medical need.
I also found that I wouldn't lose my
job and I wouldn't lose my health insurance. I could pretty
much make my own schedule and do it as long as I needed to, day
after day, week after week, and month after month. Then start
it all over again the next year.
Not only that, your employer cannot have you
make-up the time lost. He can't have you work late when you do
come in and he can't make work on the weekend to make up the hours.
End of story.
Employees have no clue about such things
because the information they are given in their employee handbooks
only describe the laws at a very high level. Like I said in
Part I, employment law attorneys get paid to train supervisors in
how to minimize employees' rights. When training employees,
they conveniently leave out the sections of the law that are most
helpful to individuals. Your boss wants to keep you in the
dark, and will pay a lot of money to keep you from finding out about
how to use your employment rights.
For a more in-depth look at state and federal laws that protect an
employee's rights, download Work Laws Exposed. No one should
enter the job place without it. It's very easy to understand
and you'll receive step-by-step help. Your employer doesn't want you
to find out how you can protect yourself because he's having too
much fun making your life miserable.
